
What is Estate Planning?
An estate plan is a specific plan for how to manage property during the client's life, and more particularly, how to distribute property upon death.
The goal of any estate plan is efficiency. Efficiency means minimizing taxes, reducing costs, mitigating in-fighting, and protecting the client's legacy from creditors, predators, and divorce.
There is no "estate planning" law. To be an effective estate planner requires knowledge of many different bodies of law, such as property, probate, trusts, incapacity, public benefits, divorce, business, and especially tax.
Estate planning attorneys use a broad range of tools such as Wills, Trusts, Powers of Attorney, asset titling, death beneficiary designations, entities (LPs, LLPs, LLCs, Corporations), promissory notes, installment sales, and insurance.
